乙方:身份证号码:

甲、乙双方经过协商就房屋买卖一事,在平等、自愿、诚实信用的前提下,达成如下协议:

(一)该房屋座落于,建筑面积为平方米,公共部位与公用房屋分摊建筑面积平方米。

(二)出售房屋的所有权证证号为:

(三)房屋平面图及房产证:。

(四)房屋内的一切设施设备归乙方所有,除空调及家电家具设施设备外。(太阳能及抽油烟机费用再另外付款,不计于房屋款内)。

(五)店面里的商品及柜架包括在房屋款内,归属乙方。

付款方式

甲方必须协助把房产证和建房证过户到乙方后,乙方在20xx年2月25号前一次性付清全部房款人民币壹拾陆万壹仟元整,甲方收到房款后出具收据。

细则

甲方在20xx年2月25号前腾空搬离该房屋,可占用三楼一间房堆放物品,待房款全部付清后彻底搬出,房产证没过户前,经双方协商,以书面形式出售给乙方。

(一)甲、乙双方同意,双方应于本合同生效之日起日内,必须出示有效证件或本人亲自和乙方一起去房产主管部门办理过户手续。

(二)办理过户手续如需要甲方出面处理的不论何时何地,甲方必须协助,如因甲方的延误而影响过户登记,因而蒙受的损失由甲方全额负责赔偿。如甲方原因不能办理过户登记,乙方有权解除合同,解约时甲方应返回全部房款。

甲方如不按合同规定的日期办理房产过户及交付房屋每逾期一天按房屋总价的千分之五(5‰)计算违约金付与乙方。

本合同未尽事宜,甲、乙双方可另行补充条款,及本契约的附件均为本契约不可分割的部分。

甲、乙双方在履行本合同中,发生争议应协商解决,协商不成的由房屋所在地人民法院起诉。

甲方保证已如陈述上述房权属状况和其他具体状况,保证该房屋没有设立担保,没有权属纠纷,保证该房屋不受他人合法追索。

本合同一式叁份,其中甲方留执1份,乙方留执1份,为申请房屋所有权转移登记提交房屋权属登记机关一份,均具有相同的法律效力。

本合同自甲、乙双方签定之日内村上盖章生效。

4、本合同签订后,因甲方单方违反合同不履行条约要求退还房产的,包括他人因甲方原因提出房产权属的,可以按已付房款和房屋建设装修等相关费用及利息,利息为银行同类贷款的4倍,并按照房款总额100%的违约金来进行赔偿。也可以根据本房屋的市场评估价和相关费用另外加房款总额100%的违约金来进行赔偿,以上两种赔偿方式由乙方选择。

5、违约责任:本合同签订后,双方应严格履行。如一方违反本合同条款,应向对方履行加倍赔偿。当甲乙一方无民事能力时,其监护人负民事赔偿责任。

6、本合同壹式2份,甲、乙双方各持壹份,各份均具有同等法律效力,经甲、乙双方签字盖章之日生效。

7、乙方在需要修改产权底单和变更大产权以及办理其它关于产权方面的手续时,甲方应出具相关证明并且配合乙方办理相应手续。甲方在配合乙方成功变更产权后,乙方须支付甲方费用___________元。
