购房合同怎么补办篇一

乙方(买受人):身份证件号码:

甲乙双方经过有好协商,就房屋买卖一事,在平等、自愿、诚实信用的前提下,达成如下协议:

第一条:甲方自愿将其房屋出售给乙方,乙方也已充分了解该房屋具体状况,并自愿买受该房屋。该房屋具体状况如下:

(一)座落于北道三马路“永生家园“号楼单元室,建筑面积为平方米;套内建筑面积平方米,公共部位与公用房屋分摊建筑面积平方米;

(二)出售房屋的所有权证证号为;

(三)房屋平面图及其四至见房产证;

该房屋占用范围内的土地使用权随该房屋一并转让。该房屋的相关权益随该房屋一并转让。

出卖人还应当将附属于该房屋的阳台、走道、楼梯等,转让给买受人,其转让价格已包含在上述房屋的价款中,不再另行支付价款。

第二条:甲方保证已如实陈述上述房屋权属状况和其他具体状况,保证该房屋没有设定担保、没有权属纠纷,保证该房屋不受他人合法追索。

第三条计价方式与价款及钥匙的移交

按套计算价款,房屋总金额人民币(肆拾玖万元整{包含家具})。

一、房价款的支付方式:房价款分两次付清;

二、支付时间为:

第一次付款:乙方在20xx年月日前付给甲方定金(人民币,)元,(大写)元。(定金在乙方最后一次付款时充抵房款)。

第二次付款:乙方在20xx年月日付给甲方人民币,)元,(大写)元;

三、乙方房价款付清后,甲方将房屋钥匙、房产证、原始发票及契税发票移交乙方。

第四条

1、甲、乙双方定于乙方在房款付清之日,正式交付该房屋钥匙。

2、甲方协助乙方向有关部门申请办理房屋产权的过户手续。

第五条:该房屋土地使用权为出让取得,其土地使用权证证载权利和相关出让合同的权利、义务一并转让给乙方。

第六条:乙方房款全部付清后,甲方须及时交付房屋钥匙给乙方,甲方如果违约,乙方有权解除本合同。解约时,甲方除将已收的房价款全部退还乙方外,并应赔偿所付房价款按日1‰计算的赔偿金给乙方。逾期超过30天,乙方有权解除本合同。

第七条:乙方全部或一部分不履行本合同约定的日期给付房价款时,其逾期部分,乙方应加付按日1‰计算的违约金给与甲方。逾期超过30天,甲方有权解除本合同。

第八条:该房屋毁损、灭失的风险自房屋钥匙正式交付之日起转移给乙方。

第九条:该房屋钥匙正式交付前,物业管理、水、电等相关杂费,由甲方支付清后方才交接给乙方。

第十条:本合同未尽事宜,甲、乙双方可另行订立补充条款或补充协议。补充条款或补充协议以及本契约的附件均为本契约不可分割的部分。

第十一条:甲、乙双方在履行本合同中若发生争议,应协商解决。协商不成的,由房屋所在地人民法院起诉管辖。

第十二条:本合同一式叁份。其中甲方留执壹份,乙方留执壹份,为申请房屋所有权转移登记提交房屋权属登记机关壹份。均具有相同的法律效力。
