购房合同怎么补办篇一

借款人:_________________________(以下简称乙方)

根据《_________住房困难实施方案》(以下简称方案)的规定,为解决中青年科技骨干的住房问题、稳定科技人才队伍、实现知识创新工程的目标,甲方对符合条件的中青年科技骨干给予一次性购房补贴。在乙方为甲方工作未满十年的条件下,本补贴款暂以借款形式发放,鉴于此,甲乙双方在协商一致基础上达成如下协议:

第一条 借款人的资格条件

借款人应为_______年______月______日前年龄在45周岁以下(含45周岁)的现在岗的中青年科技骨干,包括所属(控股)公司人员。其资格由借款人的工作部门和所任教处共同确认。

第二条 借款人的购房补贴标准

根据《方案》的规定,借款人的购房补贴面积为_______平方米,全额/差额补贴金额为_______元人民币。大写:_________元整

第三条 借款的用途

本借款是为解决住房困难的一次性达标补贴款,需专款专用,乙方只能用于购房,不得挪作他用,不以现金兑付。

第四条 借款的程序

乙方持与房地产开发商签订的购房合同,填写购房申请表,经所在部门和甲方人事处认定资格后,与甲方签定本借款合同,凭上述材料到甲方财务处领取购房补贴借款,由甲方以支票形式给付。

第五条 借款人所购房屋的产权归属

借款人购买的房屋产权归个人所有,在乙方能保证为甲方工作满十年的前提下,乙方可以自由处置。

第六条 乙方工作年限的具体计算方法

乙方为甲方工作十年即取得本购房补贴借款的所有权。

本十年工作年限,以创新后实际工作年限为准,创新前即在甲方工作的人员,三年工龄折抵创新后一年工龄(具体计算方法见《方案》)。

第七条 经计算,乙方尚须还款_________元人民币。大写:_________________元整。

第八条 乙方为甲方工作年限未满的处理

乙方无论因何种原因,实际为甲方工作年限未满十年,则不能全额取得购房补贴,调离时需按不足年限的比例退款。

第九条 担保

乙方持因私护照出境而暂时离开甲方的工作岗位,如果乙方对甲方的十年服务期未满,则乙方在办理出国手续之前,需向甲方提供担保人,作为归还甲方借款的担保。如果乙方不能继续履行与甲方的劳动合同,又不归还借款,由担保人负责归还本合同第七条规定相应比例退款。

担保人应限定为甲方的正式员工,由甲方、乙方、保证人三方签订担保合同,担保人的担保方式为连带责任。

第十条 乙方因各种原因调离甲方,不及时偿还甲方借款余额,甲方有权向人民法院提出起诉,并收回借款本金及利息。利息的计算标准按借款余额与借款年限来计算(利息按国家规定计)。

本合同经甲、乙双方签字、盖章后生效,一式两份,双方各执一份。

鉴于甲、乙、丙三方共同购买房屋一事,三方经过平等、充分协商,本着共同投资、共同受益、共担风险的原则,就共同投资购买房屋并与之相关事宜达成如下协议,以资信守:

第三条协议一旦签订则认定甲、乙、丙三方均充分了解并接受该拍卖房产的所有拍卖条件及法院告知的瑕疵内容所带来的后果及风险。三方经协商由甲方全权办理房产拍卖、过户及贷款的所有手续,约定将该合伙房屋登记在甲方名下。甲方作为该产权登记人并非合伙房屋真实的权利的全部归属,合伙房屋之所有权由甲、乙、丙三方按投资比例享有,三人分别享有的%和%%的权属。

第四条该合伙房屋原租户终止租赁后,三方可委托甲方对该房屋进行经营管理或重新对外租赁等经营事务,经营投资管理或对外租赁过程中产生的收益和相关费用由甲、乙、丙三方按投资比例承担。甲、乙、丙三方对该合伙房屋的管理、出租等经营事务享有同等的权利。如将合伙房屋出租给第三人,则《房屋租赁合同》必须由甲、乙、丙三方共同与第三人签署,否则不予出租。合伙房屋的租金可以由甲方收取,但甲方收取承租人的房屋租金后应及时归还银行贷款本息及其它该房屋的费用开支后,余额视为房产收益由甲、乙、丙三方按其所占的房屋产权份额分配,不足支付银行贷款本息部分由甲、乙、丙三方按其所占的房屋产权份额予以补足支付。如采用其它方式经营合伙房屋,则由甲、乙、丙三方另行协商。

第五条甲、乙、丙三方共同行使所购房产占有、使用、出租、收益、处分等权利,除下列情况外,如有两方方书面授权,另一方也可代为行使:

(一)合伙房屋的转让;

(二)合伙房屋的经营事项;

(三)合伙房屋的抵押、担保事项;

(四)其他有关合伙房屋的占有、使用、收益、处分等重大事项。

因一方单独对合伙房屋做出的上述事项均属无效,一方违反本条约定而给另两方造成经济损失的,应全额赔偿另两方的经济损失并按该损失额的百分之二十支付另两方违约金。

若三方对前款所述事项不能达成一致意见而影响该房屋经营时,双方可按下列约定执行:

(一)双方解除本协议,对合伙房屋进行产权分割并办理产权变更登记(因变更登记产生的各项税费由三方按产权份额共同承担),各自独立经营;

(二)双方解除本协议,合伙一方或两方可按该房屋当时的市值受让另一方或另两方的全部产权(因变更登记产生的各项税费由三方按产权份额共同承担)。

第六条房屋所有物权出卖及优先购买权如甲、乙、丙三方共同决定出售该合伙房屋,应依法进行并办理相关手续,盈利或亏损均由甲、乙、丙三方按其所占房屋产权份额享有或承担。本协议生效期间,一方或两方转让其房屋产权份额时,另两方或一方在同等价格下有优先受让权利。若甲、乙、丙一方或两方决定出售该合伙房屋,应书面通知另两方或另一方,并取得对方书面同意。不同意出售该合伙房屋的一方或两方应按合理公平的价格(市场价或评估价)购买同意出售两方或一方的房产份额。接到售房通知书15天不予书面答复的则视为同意出售该合伙房屋。接到售房通知书后既不同意出售又不愿购买,或在15天内不以实际行动履行购买承诺的,视为同意出售该合伙房屋,并应当予以积极配合。

第七条本协议未尽事宜,三方可以签订补充协议,补充协议与本协议具有同等法律效力,若甲、乙、丙三方协商一致,可以变更或解除本协议。

第八条本协议生效、履行等发生的一切争议,由三方协商解决,协商不成的,交由该合伙房屋所在地人民法院审理。
